US Terms of Service

Terms of Service for US customers ordering the Phāros Route Check as a Route Report or as an Expert Review & 1:1 Call.

1. Provider and scope

These Terms of Service apply to US customers who order the Phāros Route Check through this website or Stripe Checkout.

Phāros Route Check is a digital decision-support and advisory service for private Cyclades island and route planning. It does not arrange, sell, book or reserve transportation, accommodation, rental cars, activities, restaurants or other travel services; it does not act as a travel agency, tour operator, travel broker or booking service; and it does not receive customer funds for third-party travel services.

In these Terms, “we”, “us” and “our” refer to Duncan Fullarton as provider. When these Terms say “you”, they refer to the customer ordering the Phāros Route Check.

Phāros Route Check is the trading name of Duncan Fullarton, a sole proprietor based in Germany. It is not a separate company or legal entity.

You may place a paid order only if you are at least 18 years old and have the legal capacity to enter into a binding contract.

Names used in these Terms:

  • “Phāros Route Check” is the overall service described in these Terms.
  • “Island Match” is the free first assessment.
  • “Route Report” is the paid digital route report, delivered immediately after payment. In the German-language product it is called “Sofort-Report”.
  • “Expert Review & 1:1 Call” is the paid route report personally reviewed and finalized by a human expert, including one optional 20-minute call. The German-language contract uses the same product name and shortens it to “Expert Review”.

2. Service description

The Phāros Route Check is an individual written assessment of a Cyclades island or route decision based on the information you provide and the information reasonably available at the time of review.

The report may include recommendations on island fit, route viability, travel pace, ferry and transfer logic, season realism, budget realism, mobility, weak spots, keep / remove / add recommendations and next steps for your own booking decision.

The main service is the creation and digital delivery of the written Route Check report to the email address you provide.

We offer the Phāros Route Check as two products. The Route Report is a personalized digital route report that is generated automatically from your structured answers by our rule-based engine, without external AI services and without individual human review. It is delivered immediately after payment and does not include a consultation call. The Expert Review & 1:1 Call is a route report personally reviewed and finalized for you by a human expert. AI tools may assist with structuring, drafting and quality checks. After delivery it also includes one optional 20-minute consultation call about the delivered report, subject to the rules in Section 8.

Sample reports, report previews, screenshots and excerpts on the website show possible formats only. They do not promise that your report will have the same scope, islands, structure, graphics or recommendations.

3. Your information and responsibility

You are responsible for providing complete and accurate information during the Route Check flow, checkout and any follow-up communication.

The Route Check depends on your information, including travel dates, travel length, group, budget, planned islands, existing bookings, structured travel preferences and your main question. The structured travel preferences are non-health questions such as whether you want a rental car on the islands and how much island hopping fits your trip.

Do not provide diagnoses, medical conditions, disability details or other health information. We do not need health information for the Route Check and do not ask you to explain the medical reason behind any travel preference.

If important information is missing, unclear, inaccurate or changed after ordering, the usefulness of the report may be limited. Material changes after ordering may require a new review and are not included in the original Route Check.

4. What is not included

The Route Check is not a booking, reservation, travel agency, travel brokerage, tour operation, travel insurance, legal advice, medical advice, safety advice or visa/passport advice service.

  • Booking hotels, ferries, flights, rental cars, activities or restaurants
  • Checking live availability, live prices, booking rules, cancellation conditions or real-time schedules
  • Making, changing or cancelling reservations
  • Providing day-by-day travel planning, emergency support, travel guiding or support during the trip
  • Guaranteeing weather, ferry operations, opening hours, safety conditions, third-party services or travel outcomes

Any references to islands, regions, ferries, restaurants, activities, booking platforms or other third parties are non-binding orientation notes only. You book all travel services independently and directly with the relevant providers.

No third-party travel contract is formed through the Phāros Route Check service. You independently select, verify and contract with each travel provider.

5. Ordering, payment and total price

You place a paid order through Stripe Checkout. The price shown immediately before you submit the order is the total amount we charge for the Route Check.

For US customers, prices are displayed in US dollars unless stated otherwise. The total price and any taxes we are required to collect are displayed before you submit the order. The total shown in Stripe Checkout is the amount we charge.

A contract is formed when you place your binding order in the Stripe checkout and Stripe confirms successful payment. We then send an order confirmation email that documents the contract and includes the contract documents as PDF files.

We do not receive or store full card numbers. Payment processing is handled by Stripe under Stripe’s own terms and privacy information.

6. Digital delivery

The Route Report is delivered digitally immediately after successful payment. The Expert Review & 1:1 Call is delivered digitally by email, usually within 24 hours after successful payment and receipt of complete information, and no later than 48 hours. This is a calendar-hour commitment and includes weekends and public holidays.

If we cannot deliver within 48 hours, we will notify you promptly and you may choose either a revised delivery time or a full refund.

If essential information is missing, we may ask a brief clarification question. Delivery timing may depend on receiving the information needed to prepare the report.

7. Voluntary Money-Back Guarantee

We want you to feel confident booking the Expert Review & 1:1 Call. If, after reading your written route, and after the optional call if you choose to use it, you still do not have a route you are confident in, email us within 30 days after delivery and we will refund the price you paid.

No questions asked. Please include the email address you used for your order. We may ask for optional feedback so we can improve the service, but you do not have to provide a reason to receive the refund.

This money-back guarantee applies only to the Expert Review & 1:1 Call. The Route Report bought on its own is not covered by it. Instead, the Route Report comes with a fit promise: if the report does not reflect the travel dates, group size or islands you submitted, or is materially defective, we fix it or refund the price you paid. You can upgrade from the Route Report to the Expert Review & 1:1 Call while your report access remains active and while we offer the upgrade. The full price you paid for the Route Report is credited toward the upgrade.

The details of these promises are described in the US Refund & Money-Back Guarantee Policy.

Refunds are returned to the original payment method. Depending on your bank or card provider, it may take several business days for the refund to appear.

These promises apply only to the Phāros Route Check service and do not guarantee a perfect trip, specific travel outcome, prices, availability, ferry schedules, weather, opening hours or third-party services.

8. Optional consultation call

The Expert Review & 1:1 Call includes one optional 20-minute online consultation about the delivered report at no additional charge. The Route Report does not include a consultation call.

The consultation opportunity is part of the agreed service. It is limited to explaining and clarifying the delivered report and does not create a right to a new, changed or expanded route review.

The call must relate to the same delivered report, the same route, the same travel period and the same original question. It does not include a new route review, a new travel period, live availability checks, booking support, reservations, travel management or ongoing travel support.

Scheduling is handled by email, Calendly, or another scheduling method we provide. The consultation takes place online through the meeting link provided during scheduling. We will provide at least five available time slots within 14 calendar days after delivery.

You must book the consultation within 14 calendar days after report delivery. If you do not book a time within that window, the consultation opportunity expires unused. If you miss a booked consultation, it is considered provided if we made the agreed online meeting available at the booked time through the supplied meeting link. This does not apply if the failure was caused by us or by circumstances you could not reasonably control.

If we cancel a booked call for an important reason or if the call cannot take place for reasons within our responsibility, we will offer a replacement time slot.

9. Third-party information

Ferry schedules, prices, availability, opening hours, local rules, entry requirements, safety conditions and travel conditions can change at any time. The Route Check is based on the information available at the time of preparation.

We are not responsible for contracts you enter into with hotels, ferry operators, airlines, rental car companies, restaurants, booking platforms, activity providers or other third parties.

10. Intellectual property and personal use

The Route Check report and related materials are created for your personal, non-commercial travel decision. You may use them for your own trip planning.

You may not resell, publish, systematically copy or commercially exploit the report without our prior written permission.

The contract is between you and us. Members of your travel group may use the report for the permitted personal purpose, but they are not third-party beneficiaries and do not acquire contractual rights against us unless they are expressly identified and accepted as a co-customer.

11. Verification, disclaimers and limitation of liability

The Route Check is an orientation and decision-support service. It is not professional legal, medical, tax, insurance, safety or travel-agent advice.

You remain responsible for your travel decisions and for verifying current schedules, prices, availability, booking and cancellation terms, entry requirements and safety information directly with the relevant provider or authority before making a booking, especially a non-refundable booking. You also agree to take reasonable steps to avoid or reduce any loss.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHĀROS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES; LOST ENJOYMENT OR LOST TRAVEL OPPORTUNITIES; OR LOSSES RESULTING FROM THIRD-PARTY SERVICE FAILURES, CHANGED PRICES, UNAVAILABLE BOOKINGS, CHANGED FERRY OR FLIGHT SCHEDULES, WEATHER, OPENING HOURS OR INFORMATION THAT CHANGED AFTER THE REPORT WAS PREPARED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR ORDER, THE RELATED REPORT OR CONSULTATION, THESE TERMS, OR THE US REFUND & MONEY-BACK GUARANTEE POLICY WILL NOT EXCEED THE GREATER OF: (a) the total amount you paid us for that order; or (b) US $500.

Where applicable law does not permit this fixed cap for a slightly negligent breach of a material contractual obligation, liability for that breach is instead limited to the loss that was foreseeable and typical for this type of contract when the contract was formed.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, an express refund obligation under the US Refund & Money-Back Guarantee Policy, or any liability or consumer right that cannot lawfully be excluded or limited.

12. Informal dispute resolution and opportunity to cure

Before either party starts court proceedings, that party must first send the other party an individualized written Notice of Dispute and allow 30 calendar days to try to resolve the matter informally.

A Notice sent to us must be emailed to hallo@pharos.guide with the subject line NOTICE OF DISPUTE and must include:

  • Your full name
  • The email address used for the order
  • The order number, if available
  • A description of the facts giving rise to the dispute
  • The specific resolution you are requesting

We will send any Notice of Dispute to the email address associated with your order.

During the 30-day period, the parties will make a good-faith effort to resolve the dispute, including through correction, replacement, clarification or refund where appropriate.

To the extent permitted by applicable law, any applicable limitation period will be suspended during this 30-day informal-resolution period.

This section does not prevent either party from:

  • Bringing an eligible individual claim in small-claims court
  • Seeking temporary relief necessary to prevent imminent and irreparable harm
  • Submitting a complaint to a government agency
  • Taking action necessary to comply with a non-waivable legal deadline

13. Governing law, mandatory consumer rights and forum

Phāros Route Check is the trading name of Duncan Fullarton, a sole proprietor based in Germany. These Terms and the underlying contractual relationship are governed by German law to the extent legally permissible.

This choice of law does not deprive you of mandatory consumer protection rights that cannot be waived under the law applicable to your place of residence.

To the maximum extent permitted by applicable law, any dispute arising out of or relating to these Terms or your order must be brought exclusively in the courts of Berlin, Germany, unless Section 12 or applicable law requires otherwise.

This forum selection does not prevent you from bringing a claim in your place of residence where applicable mandatory consumer law gives you a non-waivable right to do so.

14. Communication

We communicate primarily by email. You are responsible for providing an email address you can access and for checking spam or filtering settings.

15. Changes and contract documents

The versions of these Terms and the US Refund & Money-Back Guarantee Policy applicable to your order are captured at checkout and attached to your order confirmation email as PDF files.

Later changes to these Terms apply only to future orders unless mandatory law requires otherwise.
